Preparation of extension of time and loss & expense claims on a £115m building contract in London.
The Contractor engaged with RL Huxter & Co. following successful outcomes from our support on previous smaller projects.
Our client were experiencing significant delay and disruption as a result of late provision of design and other issues and despite having made claim submissions had not managed to secure extensions of time or commercial compensation, with the Employer's Construction Manager alleging that the Contractor had failed to evidence cause and effect.
Working with our specialist delay partners at C-Sense Planning Ltd, we undertook a forensic investigation of the issues, constructed a fully evidenced as-built programme, identified the events causing critcal delay and produced a full delay analysis, quantified assessment of disruption and prolongation costs (£5m) and particularised and substantiated claim narratives.
The submission of a well-substantiated claim forced the Employer into making an assessment and entering into negotiations leading to a settlement.
