The specilaist Subcontractor (mechanical pipework) and Contractor were in dispute as to the value of the account towards the end of the subcontract works.  The Contractor had issued payless notices claiming it had overpaid the Subcontractor due to measurement errors and on the premise that the subcontract works contained defects, were incomplete and the Subcontractor owed contra-charges to the Contractor.

RL Huxter & Co. undertook a full forensic re-measurement of the works based on the Subcontractor's detailed records and valued the BoQ in accordance with the Option B Subcontract and prepared quotations for unagreed compensation events.  We also made an assessment of the amounts the Contractor claimed were owed for defects and contra-charges and prepared fully evidenced documentation for the Subcontractor to submit with a further interim application.

The dispute crystallised following the Contractor's Payment Notice and refusal to move on it's previous valuation.  Based on a risk assessment we provided on the strength of the valuations for each part of the account, our client had the confidence to refer a true value adjudication and the adjudicator found that the Subcontractor was due a considerable sum.  The difference to the Subcontractor was worth c. £700,000.
